Hire Purchase - Application Requirements, Terms & Conditions

Requirements for Hire Purchase Application (Fiji residents and citizens):

*Applicable on select products pending approval of your application:

• Mandatory minimum 25% cash deposit

• Latest two pay slips - current and previous one

• Employment confirmation letter or signed contract

• Work Staff ID (if any)

• Voter ID (if any)

• Driver License (if any)

• FNPF / FRCS Joint Card or TIN letter

• Passport biodata page (if any)

• Birth Certificate

• Recent bank statement copy (only required if we need to cite due to low income paycheck or if you own your business)

TERMS & CONDITIONS OF HIRE PURCHASE AGREEMENT

 

Section 1.0 - General Installment Period and Payment Obligation

1.1        XX weekly/fortnightly/monthly installments of $XXX.00 each is required of the buyer. 

1.2        The buyer can pay greater than minimum required amounts to clear the debt before term end but the total amount remains unaffected or fixed.

1.3        The installment period begins on XX/XX/2025, with subsequent payments falling due every _____________, until the end of agreement is reached after X months on _____________.

1.4        The agreement remains valid and binding in case of the buyer taking extra time to complete payments and does not dissolve for as long as debts are due to the business.

1.5        General installment period may be extended only by the seller’s approval.

 

Section 2.0 – Precautionary and Exclusionary Clause

2.1         The buyer must not lend, lease or sell the device for the duration of the hire without prior written approval and consultation from the seller. Doing so constitutes a breach of the agreement or contract and requires the buyer to immediately clear the balance amount in full cash.

2.2     The buyer will remain responsible for completing all payments as scheduled even in the case of loss or theft of the device or upon damage from any element of nature, therefore the seller is excluded of any warranty or insurance or other legal liabilities due to unforeseen circumstances.

 

Section 3.0 – Grace Period Allowance and Late Payment Penalty

3.1     A grace or extension period of up to 14 days or 2 calendar weeks may be allowed if the buyer fails to make a payment as per the due date schedule due to valid extenuating circumstances.

3.2     A late payment penalty fee will automatically be charged (after the expiry of the set grace period if approved) at a rate of $2.50 per day overdue, effective from 1st March 2025. This charge should be absorbed into the next oncoming installment. Warranty claim eligibility review periods are exempt from late fees.

3.3     The late payment charge will continue to accumulate until customer account becomes up-to-date, meaning partial payments will not clear or negate it.

 

Section 4.0 – Repercussions of Defaulting and Repossession of Products

4.1     Failure to meet any 30 days’ worth of installments on time or attempts to default, defraud or defame the business entity makes you eligible for legal repercussions, and will lead to the repossession / surrender / seizure of the device with no refund of payments or deposits already made. In other words, only four weeks repayment can be missed at any point in time, which must then be covered in the following month otherwise the buying party will be demanded in notice to return the device as is.

4.2     If no deposit was put down (zero deposit deal) and zero installments were made during the hire purchase period thus far, and you are subject to repossession (asked to surrender the device for defaulting on payments) after the expiry of the grace period set by the business, there will be a 10% (of assigned cash value) compensation and depreciation charge for usage without payment.

4.3     In the rare case such as the untimely death of the buyer or a life-threatening emergency situation, their spouse or next of kin may be asked to clear the remaining debt with extended timelines or discounted amounts or they will be offered the opportunity to return the items to release them from financial obligation but with no refund of past payments.

4.4     Exceeding the grace period and defaulting on the balance amount will lead to legal action being taken to recover the debt. Legal action can arrive in many different forms from various institutions either with or without prior notice. Authorities may undertake search and seizure with a court warrant if it requires entering private property and confiscating the devices under hire payment.

 

Section 5.0 – Return and Refund Window

5.1     Returns will be accepted if the product is tested to be faulty within 30 calendar days from date of purchase, after which a similar replacement unit or full refund may be issued. You must also ensure to keep the item in the originally provided condition. The return / refund window is a generous 30 days after which no such requests will be entertained. 

5.2     Returns can also be accepted within 30 calendar days for reasons such as a change of mind or if the item has been opened and used yet remains fully functional as advertised without any defects, but will incur the 10% (of the product’s advertised cash price) usage and restocking / retention fee as part of the business return policy, shown on the FAQ page on the website. This will be deducted from the security deposit and installments made within the first 30 days with the remainder refunded to the customer.

 

Section 6.0 – Warranty Claims Handling Policy

6.1     The purchase of your device includes an in-house or outsourced warranty repair and/or replacement benefit as outlined in the above section. Adhere to its guidelines and policies and follow the channel of communication if you encounter any issues. The business reserves all rights to approve or reject claims regarding warranty based on those guidelines and policies and the seller holds the power of the final say in how warranty claims are handled; whether a repair, replacement, refund or refusal is in order.

6.2     The seller has a timeline of up to 14 days to review a warranty claim and decide if it meets the free replacement or repair threshold after which the business must issue a response to the customer in question or issue a refund in accordance with section 6.3 below.

6.3     If during a warranty case review period the seller opts to offer a refund instead of a repair or replacement, it will equal 90% of the total amount previously paid by the buyer if the reported defect arises after the 30-day return / refund window, otherwise 100% refund of cash paid till date will be applicable in line with section 5.1 falling under the return / refund window policy.

6.4     If the customer claims warranty support by informing the business representative within the allocated period, they are considered exempt from late payment penalty fees on their current device, however, customer account must be up-to-date when claiming warranty coverage. 

6.5     Whenever any replacement warranty claim is approved, the customer is required to sign a replacement agreement which may specify a different or an adjusted price, interest rate and installment balance if the exact same replacement model unit cannot be arranged. Any discounts or promotional offers applied on the previous device will not carry forward on the replacement unit.

6.6     If in the rare case that a customer declines the approved warranty replacement, no refund shall be made for previous payments already made which serves to cover and compensate the business for the customer’s usage during the hire period. The customer must return the reportedly problematic device in its originally provided condition including any accessories installed at the point of sale.

 

Section 7.0 – On-Device Privacy, Asset Security and Indemnity Clause

7.1     Apple devices may have our business Apple ID account signed into it to protect itself and the business against the possibility of asset theft, unauthorized resale and default of debt repayments and will be signed out upon completion of the hire arrangement as a gesture of transfer of ownership.

7.2     Note that the Apple App Store and the SIM network itself will be open and the device will have full functionality for the buyer to use during the term of agreement with their own login credentials.

7.3     Reasonable privacy and security safeguards have been taken from the business side and no personally sensitive user data such as captured photos, videos, recordings or text messages is collected by Apple Inc. nor Rebel Computer Consulting except those government identification and work-related documents required for assessing eligibility for a hire purchase plan.

7.4     It is the user’s responsibility at all times to ensure to keep their data and device safe and not irresponsibly share private information to unauthorized or illegitimate parties that may lead to a compromise in their privacy or security. You as the user acknowledge that we in the business cannot be held legally liable for any activities or consequences thereof the user or buyer performs on their device(s). 

7.5     Rebel Computer Consulting (Fiji) as a reputable business reserves full rights to track and share the location and identification information of its assets using Apple iCloud, Samsung, Google or Microsoft services to legal or corporate authorities at any point in time in order to safeguard and indemnify itself against potential future losses whether in monetary or non-monetary terms.

 

Section 8.0 – Breach of Contract Clause

8.1     If the customer, including any guarantors, fail to uphold each and every section of the terms and conditions outlined in this document, it automatically constitutes a breach of contract and therefore empowers the seller and all legal and corporate parties associated with the seller to take legal action in terms of confiscation of the hired or insured products or the selling party may take the buying party to court. The buying party will receive no recompense or recovery of their funds which will be retained by the seller in the entirety of the amounts previously paid up as compensation for damaging the trust of the signed contract, unless ruled otherwise by a court of law.

8.2     Rebel Computer Consulting (Fiji) reserves all rights to modify terms and conditions with or without prior notice whereby changes will apply to future contracts.
